This is an appeal from a judgment of the trial court sustaining a motion for summary judgment filed by Rapides General Hospital. We have determined that the motion was erroneously granted, and judgment must be reversed.

Benjamin F. Garlington was injured during his employment with the Rapides Parish School Board on or about May 8, 1970. He underwent surgery for a laminectomy performed by Dr. Daniel M. Kingsley at the Rapides General Hospital...
