HANSON, Justice.

The appellant, George Asimakis, was originally charged with burglary in the third degree and grand larceny in the Circuit Court of Brookings County. He entered a plea of guilty to grand larceny and the burglary charge was dismissed on motion of the state's attorney. Appellant was sentenced to three years in the state penitentiary. After serving approximately five months, appellant petitioned the Circuit Court of Minnehaha County for a writ of habeas...
