On January 19, 1973, defendant Robert L. Patterson appealed as of right from a denial of a motion for retrial. On March 16, 1973, this Court, in acting upon a motion for peremptory reversal, agreed with defendant's position arguing that the sentence of three to four years was in violation of the indeterminate sentence act and accordingly issued an order reducing
