YOUNG, J.
This cause came to be heard upon motion of the plaintiffs for summary judgment and upon cross motion of the defendants for summary judgment, both pursuant to Rule 56, Fed. R. Civ. P. The parties state to the court that there is no genuine issue as to any material fact and the court finds the case in the proper posture for ruling under the provisions of Rule 56.
