The Cleveland Trust Co., plaintiff herein, and trustee under an inter vivos insurance trust agreement entered into October 13, 1941, and modified by modification of September 21, 1951, with Howard F. Schumacher, deceased, as settlor, seeks an order of this court declaring the rights of the adopted children of a daughter of Howard Schumacher under said trust agreement.
