On April 9, 1970, J. C. Matthews and Betty V. Trubic were killed in an automobile accident. The surviving wife and children of J. C. Matthews filed suit against Newman Brothers Truckline Company, owner of one of the vehicles involved in the accident, under Tex.Rev.Civ.
