This appeal involves a judgment in favor of the plaintiff, David L. Cross, against the Missouri Pacific Railroad Company, defendant, in a personal injury suit brought under the Federal Employers' Liability Act, 45 U.S.C.A. Sec. 51 et seq. Upon a jury finding of total damages to Cross in the sum of $30,000, and findings that the negligence of Missouri Pacific was the proximate cause "in whole or in part, of the injuries," the trial court rendered judgment...
