OSBORNE, Justice.

The defendant, Lee Ernest Coleman, was indicted for murder, convicted of voluntary manslaughter and sentenced to twenty-one years' imprisonment. The indictment charged that on the 5th day of January 1972, he beat to death an individual by the name of Gladys Lewis with whom he was living at the time without benefit of clergy.
