Casey Horton was charged, in a two count indictment with violation of the Uniform Narcotic Drug Act. On April 15, 1971, the defendant was acquitted by verdict of the jury of the charges contained in one of the counts and on June 8, 1971, the other count was dismissed during a bench trial at the close of the Peoples' evidence.
