Appellant Ronald Burket, along with Terry Davis, Theodore Bortz and Ferdinand Santana, were charged in a four count indictment in the District Court for the Western District of New York with conspiring to violate 18 U.S.C. § 2113 and with three substantive violations of that section as a result of armed robbery of a bank in Buffalo, N.
