DOUGLAS, Judge.

This is an appeal from a conviction for the possession of marihuana. The jury assessed the punishment at three years.

The record reflects that officers pursued the Volkswagen that the appellant was driving on Westheimer Street in Houston at approximately forty-five miles an hour in a thirty mile an hour zone.
