In 1959 Kenneth Anton brought suit against the parties to this appeal, Rudy Mallonee and William Grow1 alleging that they had committed trespass to land and had wrongfully converted a tractor. Mallonee cross-claimed against Grow on the basis that he acted as Grow's agent and was entitled to indemnity from Grow for any amount that Anton might recover.
