Police officer, Lloyd Peterson, in uniform, was patrolling the area in the 1200 block of 19th Street, Chicago, Illinois, at about 4:45 A.M., of September 20, 1970. He observed four men, including defendant, Francisco Herrera and one Richard Garcia, who appeared to be setting fire to an automobile. The officer ordered them to put up their hands. They ran and were chased down 19th Street...
