This is an appeal from a final decree of the Circuit Court of Morgan County, in Equity. The trial judge, in his final decree set out his findings of fact, in part, as follows:

"This suit was initiated by a petition styled `PETITION FOR A DECLARATORY JUDGMENT' filed in this Court on the 14th day of July, 1970, wherein the plaintiff, John W. Long, alleged that he had entered into a (sic) oral contract or arrangement with the defendant, Bonded...
