Appellant, a paroled prisoner of the State of Oregon, appeals from an order of the district court dismissing his petition for writ of habeas corpus.

Following state trial before the court, sitting without a jury, appellant was convicted of the crime of manslaughter by abortion, and on September 14, 1967, was committed to imprisonment for a term not to exceed four years, together with the imposition of a fine in the sum of $100.00.
