The defendant Joseph J. Sommer as administrator of the Bureau of Workmen's Compensation has moved for a summary judgment. The court construes this to be a motion to dismiss the petition under Rule 12, Paragraph B—Paragraph 6 that the petition fails to state a claim upon which relief can be granted.
