Defendant Malcolm Heber was convicted by a judge, sitting without a jury, of embezzlement, MCLA 750.174; MSA 28.371.

At trial, the prosecution's evidence showed Edwina Patzkowsky, a long-time friend of the defendant, hired defendant sometime in December, 1965 to represent her interest in her brother's estate.
