This is a diversity case in which the plaintiff in a suit filed in United States District Court for the District of New Mexico sought damages for personal injuries which he sustained while working as a lineman near Los Alamos, New Mexico. The plaintiff-appellant had climbed a pole preparatory to its being replaced. He was seriously injured when the pole fell. Morris was an employee of Gottlieb Contracting, Inc.
