The appellant Ellie G. Irvin was indicted by the Grand Jury of Monroe County, Mississippi, on a charge of pointing, aiming and discharging a deadly weapon at and toward one Bobby McKay. He was convicted and sentenced to serve a term of six months in the county jail and to pay a fine of five hundred dollars ($500.00). One-half of the fine and three months of the jail sentence were suspended.
