This is an appeal by Dannie Wayne Shelton, appellant (defendant below) from a conviction in the Vanderburgh Circuit Court for conspiracy to commit a felony — theft. The defendant was charged by affidavit on March 15, 1971. He was tried by jury which returned a verdict of guilty on May 27, 1971.
