MEMORANDUM OPINION

GORDON THOMPSON, Jr., District Judge.

The defendant stands charged with the unlawful possession of a controlled substance, in violation of 21 U.S.C. § 844. The charge stems from the defendant's apprehension at the Mexican-American border on December 4, 1971, while driving a car belonging to his co-defendant Charles Bland in which 5 grams of heroin were found. Bland testified at trial that he and the defendant had agreed to go to Mexico...
