ERICKSON, Justice.

The defendant, Domingo Sandoval, was charged and convicted by a jury of the crimes of aggravated robbery and conspiracy to commit aggravated robbery. He was sentenced to the penitentiary, and thereafter, his conviction was affirmed on writ of error. Sandoval v. People, 162 Colo. 416, 426 P.2d 968 (1967). See the companion case, Duran v.
