Plaintiff, Burrell Dulaney sustained serious injuries in an oil well fire which erupted near Oberlin, Louisiana on August 17, 1968. As a result he initiated litigation which, following considerable legal maneuverings, the involvement of a number of parties, and a prior mistrial, culminated in the judgment herein appealed.
