Plaintiff instituted this suit for workmen's compensation benefits alleging his total permanent disability as the result of a work-connected accident and additionally seeking penalties and attorney's fees. After a trial on the merits the district court rendered judgment in favor of plaintiff awarding him compensation for total, permanent disability from the date of the alleged accident, but denied his claim for penalties and attorney's fees.
