ONION, Presiding Judge.

This is an appeal from a conviction for assault with intent to commit murder where the punishment, enhanced under the provisions of Article 63, Vernon's Ann.P.C., was assessed at life.

The sufficiency of the evidence as to the primary offense is not challenged. Suffice it to say that the evidence shows that the appellant shot and seriously wounded a Harris County deputy sheriff who attempted to arrest the appellant...
