BROWN, Justice.
This is an appeal from the granting of a summary judgment to appellee, Hoyt L. Brown, and against appellant, The City National Bank of Fort Smith, Arkansas. Both parties filed motions for summary judgment. Based on the pleadings, along with the affidavit filed by appellant, it is contended that in fact appellant's motion for summary judgment should have been granted.
