Defendant having been indicted for the crimes of rape in the first degree and carnal abuse, was convicted, after a jury trial, of rape, first degree, and sentenced to a term of one day to life. On April 25, 1966 at about 5:45 P.M., the victim, age 3, was found missing from her home. A search was made and she was discovered crying, sometime before 8:10 P.M. by some neighborhood boys and returned home.
