Plaintiff has brought this action to challenge the legality of a grant of funds made by the Economic Development Administration of the Department of Commerce equal to 80% of the estimated cost of constructing a road in the Elk Mountain area of San Miguel County in northern New Mexico, known as the "Elk Mountain Road Project".
