The amended complaint was subject to attack in that two different causes of action were pleaded in a single cause of action, viz.: fraud and conversion. However, this point was not raised and the case proceeded to trial on both theories. There was sufficient evidence at the trial to require the court to charge, not only on fraud, but also as to conversion. Fedeli did not have title to the merchandise.
