This is an appeal from a conviction for murder where the punishment was assessed at 65 years.

The sufficiency of the evidence is not challenged. Suffice it to say the record reflects that the deceased, Byron Richardson, was City Marshal of Cross Plains, Texas, and that during the early morning hours of July 2, 1969, he encountered the appellant and his wife. The deceased...
