OPINION

ODOM, Judge.

The offense is burglary. The punishment was assessed by a jury at 12 years.

The state's evidence reflects that on December 23, 1968, at approximately 3:40 A.M., Officer O. L. Elliott, of the Haltom City Police, was patrolling in a business-residential area of the city when he saw a Ford panel truck coming from behind some buildings without its lights on.
