UNDERCOFLER, Justice.

The Standard Oil Company, a division of Chevron Oil Company, as transferee, filed a petition seeking specific performance of an option contract wherein the defendant had agreed to convey described real property upon payment of $15,000. A motion to dismiss for failure to state a claim was filed and overruled by the trial judge. This court affirmed such ruling on appeal. See Smith v. Standard Oil Co.,
