A jury found appellant guilty on two counts of a three-count indictment. Count I charged that he had knowingly and willfully committed a depredation against the property of the United States in violation of 18 U.S.C. § 1361. Count III charged that appellant had unlawfully and knowingly failed and neglected to perform a duty in the execution of the Selective Service Act of 1967 in that he failed to submit to an Armed Forces physical examination...
