Haire, defendant, was indicted for first degree murder for the killing of Freddie Lee Jackson, a sixteen-year old Negro boy.1 Upon trial to a jury defendant was convicted of second degree murder and on direct appeal his conviction was affirmed by the Arkansas Supreme Court.
