RIVES, Circuit Judge:

Green was convicted of the theft1 of 525 cases of Cutty Sark Scotch Whiskey, 105 cases of Hennessy Cognac, and 95 cases of De Vin Wine, which were moving as an interstate shipment by motor truck from the Alabama State Docks in Mobile to the Collector of Customs in Nashville, Tennessee. He was sentenced to imprisonment for six years.
