OPINION

ONION, Presiding Judge.

This is an appeal from a conviction for driving a motor vehicle upon a public highway while intoxicated. The punishment, assessed by the jury, was 7 days in the county jail and a fine of $75.00.

The sufficiency of the evidence is not challenged. Suffice it to say the record reflects that the appellant was arrested by Dallas Police Officer Parrish at 12:20 a.m. on December 20, 1969, while driving a Chevrolet automobile...
