RUSSELL, Judge.

The appellant, Van Allen Beaver, was convicted of first degree murder in the Criminal Court of Shelby County in 1965, and his punishment was fixed at death by electrocution. Execution of this sentence has been stayed during pendency, first, of his direct appeal (Beaver v. State, 220 Tenn. 133, 414 S.W.2d 841
