On August 16, 1963, at 4 A.M., automobiles driven by the plaintiff Kirk, an Indiana citizen, and Reverend Jerome Brzozowski, an Illinois citizen, collided on the Calumet Expressway in Cook County, Illinois. On November 1, 1963, Kirk filed a personal injury action against Brzozowski in the district court for the Northern District of Illinois. The defendant, Home Indemnity Company, a New York corporation, which was Brzozowski's liability insurer...
