Claimant owned a tract of land with 220 feet frontage on both the north and south sides of Route 28 in the Town of Shandaken, Ulster County. On the north side was a restaurant, guesthouse and residence and claimant catered to fishermen, hunters, skiers and vacationers. On the south side the entire property was appropriated in fee, .142 acre thereof being land area and .056 acre being within the bed of Esopus Creek, a prime fishing stream.
