This is a workmen's compensation suit which was instituted by Robert Dale Smith on March 25, 1968, fourteen days after an accident which occurred on March 11, 1968. The petition prayed for a judgment of $35.00 per week for four hundred weeks, plus $2,500.00 medical benefits, with penalties and attorney's fees. The suit was filed only against Kelly Labor Service.
