Defendant instituted this coram nobis application seeking to be resentenced, alleging that he was not advised of his right to appeal his conviction upon his plea of guilty in 1955, and relies on the decision in People v. Montgomery (24 N.Y.2d 130). The District Attorney urges that People v. Montgomery (supra), is distinguishable since in that case the conviction was after a trial and not upon a plea of guilty...
