Defendant first assigns as error the failure of the trial court to grant his motion for nonsuit and his motion to set the verdict aside as being against the weight of the evidence. On this assignment defendant argues that the evidence was insufficient to support the verdict for that there was no substantial evidence that any injuries allegedly received by Lt. Carr were of a serious nature.
