This is an appeal from a summary judgment dismissing plaintiff's suit as to two of several defendants.

Those two defendants, an employer and its insurer, showed that there is no genuine issue as to fact material to the question whether the employee was in course and scope of his employment at the time of the accident attributed to his alleged negligence. They did not show the absence of issues of fact material to other elements of plaintiff...
