ONION, Judge.

This is an appeal from a conviction for murder wherein the penalty was assessed at 50 years' confinement in the Texas Department of Corrections.

The sufficiency of the evidence is not challenged. Suffice it to say the evidence shows that on December 25, 1968, the appellant shot and killed Howard Williams who was employed at the Sat El Lite Club in San Antonio "to keep peace." Appellant and two companions, who had been drinking...
