MEMORANDUM BY THE COURT.

When the jury returned the verdict in favor of the passenger Burrows, the negligence of the defendant Stone was established as to the factual issues in the action. The record is devoid of any evidence which could establish legally or factually contributory negligence as to the plaintiff Martin, the operator of the automobile in which the passenger was riding, and while there is a factual issue as to the degree and seriousness of the injuries...
