As so modified, judgment affirmed. Order of the same court dated August 18, 1969 modified, on the law and the facts, by striking from the decretal paragraph thereof the following: "denied, in the discretion of this Court" and substituting therefor: "granted to the extent that plaintiff is directed to pay defendant $350 for such counsel fees". As so modified, order affirmed.
