William Ellis Van Winkle, hereinafter referred to as defendant, was tried and convicted of five counts of rape second degree and one count lewd and lascivious acts and was sentenced to serve not less than seven and one-half years nor more than fifteen years in the Arizona State Penitentiary upon each count to run concurrently.
