In our opinion, the fact that an associate of retained counsel appeared in his stead and represented defendant at the time of sentencing did not per se warrant a conclusion that defendant was, in effect, deprived of his right to counsel of his own choice in violation of his constitutional rights. It is our view that such claim, under the undisputed pertinent facts and circumstances adduced at bar, is without merit and that a hearing would have served...
