This is a suit in tort instituted by plaintiff against the defendant, the insurer of the Town of Rosedale, Louisiana, to recover damages for the loss of her four-year-old son, Lonnie Scott, who died as a result of drinking some poisonous weed killer from a barrel on the open premises owned by the Town of Rosedale, Louisiana. The defendant answered, alleging its insured, the Town of Rosedale, was free of fault, and in the alternative alleged contributory...
