COOKE, J.

This is an appeal from a judgment of the County Court of Fulton County rendered November 20, 1969 upon a verdict convicting defendant of the crime of reckless driving in violation of section 1190 of the Vehicle and Traffic Law, as charged in one count in the indictment. The jury found defendant not guilty of criminally negligent homicide (Penal Law, § 125.10), as accused in a second count.
